| Establishing Responsibility: Negligence, Strict Liability and Intentional Conduct |
| Posted By Patrick Rogan |
 |
| If you have been injured in Scranton, but don't know whether you have a solid case against the party that caused your injuries, then you should speak with a Scranton personal injury lawyer. An experienced Scranton personal injury attorney will tell you that establishing legal responsibility, or liability, is among the first tasks you and your attorney will need to tackle.
There are really three kinds of liability: negligence, strict liability and intentional conduct. Negligence means a failure to act with proper caution or reasonable care. Strict liability refers to situations in which defendants can be held accountable regardless of intent. Intentional conduct is just as it sounds - it refers to situations in which one party willfully or intentionally harms another.
A
Scranton injury lawyerat Rogan Law can work with accident reconstruction specialists, medical professionals, economists, private investigators and other qualified professionals to conduct investigations and to act as expert witnesses for your case, helping to prove the liability of the defendant in your Scranton accident case. If someone else caused your injuries, then we will work with you to prove it.

| The Pocono Record's reports of last Friday's police chase and fatal Poconos car crash demonstrate how tragically things can end when one person makes the reckless choice to put his life and the lives of others in danger. Getting behind the wheel of a car always puts a person at some risk, but drivers who behave with abject carelessness create grave and unnecessary dangers for those with whom they share the road.
While the man responsible for this accident will face myriad criminal charges, no recompense will be made to his victim's family unless they file a civil lawsuit against him and demand compensation for their immeasurable loss. Though legal action may seem a weak response in the face of such a life changing event, a Poconos auto accident attorney can file a wrongful death lawsuit that will help victims' families recover funeral costs, medical bills, and more.
Rogan Law represents families who have lost a loved one in all types of motor vehicle accidents throughout the Poconos. Contact a Poconos auto accident lawyer at Rogan Law today for a free accident consultation.

| Injured in Drunk Driving Accident? |
| Posted By Patrick Rogan |
 |
| Recent Times Leader reports about a local drunk driving accident involving a young woman from Towanda, who was driving with a BAC twice the legal limit, and a U.S. Congressional candidate from Lycoming County bring home the fact that drunk drivers can change any of our lives at any moment.
They may not always make the papers, but Wilkes-Barre drunk driving accidents injure and/or kill far too often. Nationally, drunk driving accidents account for approximately one-third of all fatal accidents; someone is killed in a drunk driving accident every 45 seconds.
If you have been injured in a car accident caused by a drunk driver, then it is important that you consult a Wilkes-Barre accident attorney as soon as possible. With the help of a Wilkes-Barre accident lawyer, you can seek the financial compensation to which you are entitled. You can also take legal action against the driver who caused the accident and your injuries.

| Scranton Drunk Driving Accidents |
| Posted By Patrick M. Rogan |

| The Times-Tribune reports this morning on a problem law enforcement officers are facing here in NEPA and nationwide - DUI offenders who are arrested, processed and released, only to immediately commit the same crime. There have been three of these kinds of cases in our area just this year.
Repeat DUIs present a major threat to public safety, as do all drunk drivers, who cause injury and death to innocent people every day. If you have been injured or have lost a loved one in a drunk driving accident, then you know that drunk drivers present more than a legal conundrum; they can take away your health and even your life.
In addition to the legal consequences a drunk driver faces, you can bring a civil lawsuit to seek financial compensation. Such settlements can help pay for medical expenses, funeral costs, emotional trauma, pain and suffering, loss of companionship and lost wages. The money cannot take away your pain, but it might provide you with the resources you need to begin healing.

| Cell Phone Use While Driving: Mountain or Molehill? |
| Posted By Patrick M. Rogan |
 |
| A friend and fellow NEPA personal injury lawyer recently vented online regarding his frustration with Oprah Winfrey's high-profile campaign against cell phone use while driving. He asked: They were designed as car phones, weren't they? Does the number of people hurt really warrant Oprah's response?
Another Scranton personal injury law firm doesn't seem to think so. Shortly after reading my friend's words, I heard a radio advertisement from a large, local firm encouraging listeners to call in from their cell phones. The ad emphasized the convenience of multitasking - but is the convenience worth the risk?
The US Department of Transportation doesn't think so. With 6,000 people killed and 500,000 injured each year by distracted drivers, increasing numbers of whom are cell phone users, the Department has launched a major campaign to educate the public about the dangers of mixing cell phones and driving and to mobilize change. One of the most interesting statistics the Department cites: Using a cell phone - even hands-free - while driving delays drivers reaction as much as their having a BAC of 0.08, for which they could be arrested for DUI in PA.
If you are injured by a distracted driver, then you need an NEPA auto accident lawyer who takes driver negligence seriously. At Rogan Law, we understand that, when you are the one injured because someone else's phone conversation was more important than your life, the issue of driver distraction is very important, indeed.

| Listening to NPR, I recently heard a story discussing emerging evidence that the massive, catastrophic oil spill that continues to contaminate the Gulf of Mexico was caused by as series of human and equipment failures that could have been prevented by better regulatory oversight.
What a shame that the only way we can rely upon many people and corporations to do the right thing is to watch their every move. How much better the world would be if we all thought, seriously and responsibly, about the impacts of our own actions.
People make decisions all the time that have devastating, catastrophic consequences for others. Virtually any accident may result in serious, life-changing injuries such as brain injuries, burn injuries, amputation, blindness, spine injuries or paralysis.
If you or a loved one has been treated for serious injuries in an accident caused by someone else's negligent behavior, then a Scranton serious injury attorney from Rogan Law can help you. A Scranton serious injury lawyer from Rogan Law is both qualified and passionate about helping you in your time of need.

| CMC Accused of Wrongful Death, Failure to Diagnose |
| Posted By Patrick M. Rogan |
 |
| The Times-Tribune reports that Community Medical Center (CMC) in Scranton and one of its emergency room doctors are facing accusations of wrongful death for failing to diagnose the life-threatening symptoms of a man who sought treatment at the hospital but was released rather than hospitalized for his injuries. Hours after his release, he died in a car accident after losing control of his vehicle.
Cases like this are tragic. Whether the courts will hold these particular defendants responsible depends on many factors. One thing is for sure, the quality of the legal representation each side chooses will significantly impact the outcome. A good Scranton personal injury lawyer can make all the difference in a Scranton wrongful death case.
Medical malpractice, failure to diagnose and wrongful death are heartbreaking realities in the healing profession. Losing a loved one at any time and for any reason is hard enough to bear, but losing a loved one and knowing that it could have been prevented adds to the pain and difficulty.

| NYC Explosion Narrowly (Thankfully) Averted |
| Posted By Patrick M. Rogan |
 |
| When people from Scranton refer to "the city," such as when they say, "I'm going to the city this weekend," or "I went to the city for dinner and a show," they usually are talking about New York City. New York is OUR city, the place we visit when we need a dose of art, culture, baseball or the incredible diversity only NYC can offer. No offense, Philadelphia - we love you, too, but New York holds a special place in many of our hearts.
When something bad happens in New York, it does not feel like it happened in a far away place. Rather, it feels like it happened in our own backyard. Maybe that is why news about the failed car bombing in Times Square this past weekend aroused such feelings of anger, anxiety and upset here at home. News of terrorist attacks anywhere shock and sadden us, but news of terrorism in NYC stops us in our tracks.
Thankfully, no one was hurt. I hope the police, FBI and other law enforcement piece together the evidence and find the responsible party quickly and without further incident. I wish no one from Scranton, NYC or anywhere else ever had to deal with situations like this. Unfortunately, in our world, people hurt other people all too often.
Getting hurt and recovering from injuries is always hard. Getting hurt and recovering from injuries because someone meant to hurt you, or even because they neglected to take common sense precautions to avoid doing so, is somehow harder.

| Personal Injury Lawyer Scranton, PA |
| Posted By Patrick M. Rogan |
 |
| As a personal injury lawyer in Scranton, PA, one of my main professional objectives is to help clients who have been injured as a result of someone else's negligence to recover the money they need to rebuild their lives and to recover physically, emotionally and financially.
Though putting money at the beginning and ending of that equation may seem crude to someone who has never been devastated by a serious accident, people who have had the great misfortune of finding themselves in that situation know that you need money at every point in the healing process: Health care, rehabilitation, counseling, lost wages - every one of those challenges comes with a price tag attached.
In reality, your chances of receiving the level of financial compensation you need and deserve are materially enhanced by your choosing to work with a knowledgeable personal injury attorney who will fight hard for you. A Scranton personal injury lawyer from Rogan Law will work tirelessly to give you your best chance at success.

| Stroudsburg Serious Injuries Lawyer |
| Posted By Patrick M. Rogan |
 |
| As a
Stroudsburg serious injuries lawyer, I read with interest today's article in the
Pocono Record detailing a stimulus-funded plan to improve Monroe County's Route 33. The plan includes new guide rails, highway resurfacing and bridge rehabilitation, all of which could help prevent serious injuries along that stretch.
Serious injuries can be caused by Stroudsburg car accidents or by many other events, unexpected incidences or accidents. Both the young and the elderly are treated in local emergency rooms for serious injuries every minute of every day, and in many cases, someone else is actually responsible for the injuries.
As a
Stroudsburg serious injuries lawyer, I represent those victims who have sustained grievous bodily harm by a negligent party. I have over 20 years of legal expertise and extensive education in the areas of personal injury and serious injury law. I am both qualified and passionate about helping you in your time of need.

| Fatal Car Crashes Cause for Concern in Poconos |
| Posted By Patrick M. Rogan |
 |
| Do you know the leading cause of death for Americans aged 34 and under? How about the leading cause of long-term disability for Americans of all ages? Turns out if you know the answer to one question, then you know the answer to both.
Driving accidents.
The Pocono Record recently reported that driving accidents account for more than 40,000 deaths each year - that's around 120 people per day. Many additional people are seriously injured in ways that continue to impact them for the rest of their lives.
In the Poconos, fatal accidents are on the rise. Country roads, extreme weather conditions and population increases may all be factors in this deadly trend.
Losing someone you love in a car accident is almost unthinkable, but it is, unfotunately, far more likely than we want to believe. Often called vehicular manslaughter or vehicular homicide, driving-related deaths do affect many Pocono families.
If you or someone you know is experiencing this most painful tragedy, then you need to find a Pocono wrongful death attorney who will stand by your side and will build a case against the driver who caused the accident while you focus on your emotional and spiritual loss.
A Pocono wrongful death lawyer from Rogan Law can help your family begin the process of filing a wrongful death suit against the responsible party. This won't bring your loved one back, but it can help you to begin healing and provide you with financial compensation to cover funeral costs, medical bills and more.
