  Tragic Incident Reported at PA Natural Gas Drill Site

Today's Times-Tribune reports that a tragic explosion in Indianola, Pennsylvania has killed two workers at a natural gas well.  A welding project near the well is suspected to have triggered the deadly explosion and subsequent fire, though investigations as to the cause remain underway.  

My deepest sympathies go out to the families and friends of the men who were killed.

Though this particular well is not part of the Marcellus Shale system, its new notoriety highlights the dangers of natural gas drilling inside and outside the Marcellus Shale region and raises questions about the effectiveness of safety regulations that protect workers as well as people who live near the wells.

  Good News, for a Change

I'm always reading the newspaper and commenting on it in these blogs, and oftentimes, the news is less than good.  However, today's Times-Tribune cheered me up with an article reporting that Bloomberg BusinessWeek has named the Scranton/Wilkes-Barre area the tenth strongest job market in America.

That doesn't mean we are where we need to be in terms of jobs or our economy, but it does mean we are poised to begin seeing and feeling some effects from economic recovery efforts in the near future.  

But I have some lingering concerns.  The promise of Marcellus Shale gas extraction is one of the factors creating employer optimism and raising our ranking.  It remains to be proven to my satisfaction, and to the satisfaction of many residents in our region, that the natural gas industry knows how to drill safely in and around our watersheds.  It would be a tragedy if we permitted industry interests and short-term economic recovery to threaten our long-term health and sustainability as a region.

Still, I remain heartened and hopeful that those among us who have struggled the most through this recession will get some well-deserved relief very, very soon.

  Marcellus Shale Pipelines Seek Power to Invoke Eminent Domain

Today's Times-Tribune details the natural gas industry's current push to label gas gathering pipelines as utilities, which would subject the companies that own the lines to some regulation, but would also give those companies the authority to invoke eminent domain.  This could mean that, as the paper states, "Even property owners who don't want a pipeline on their land at any price could be forced to host it." 

Industry spokespersons will argue their case before the Pennsylvania Public Utility Commission at public hearings in Great Bend and Montrose on Wednesday.

  NEPA Preparing Educationally for Marcellus Shale Jobs

More news about Marcellus Shale natural gas drilling:  An article in today's Times-Tribune emphasizes not the negative impact drilling has had and could have on NEPA's natural resources, but the preparations our local educational institutions are making in response to anticipated industry demand for workers.

  New Developments in PA Marcellus Shale Drilling Plans

The Delaware River Basin Commission (DRBC) announced yesterday that it has amended its 2009 decision requiring sponsors of natural gas extraction projects to obtain permission before beginning production to also require prior permission to drill exploratory wells.  These more stringent requirements may be partially due to recent, well-publicized accidents by Marcellus Shale drilling companies.  

What are some of the issues at stake? Although the hydraulic fracturing method used by natural gas drilling companies is currently exempted from regulations contained within the federal Safe Water Drinking Act, drilling may have significant impacts on both the quantity and quality of local resources as water is diverted to supply industry needs and as pollutants are introduced into ground and/or surface water.  Treating and disposing of water contaminated by this process, handling potential problems with air pollution, and preparing for disasters also are major issues as yet under-addressed.

  Three Recent Marcellus Shale Drilling Accidents

The Times-Tribune has reported two major accidents related to Marcellus Shale natural gas drilling in the past week.  The first accident in Clearfield County, Pennsylvania, resulted in a 16-hour leak of gas and frack into the environment.  More recently, seven workers were injured in a massive explosion in West Virginia.  A third accident was reported several months ago in a state forest in Clinton County, PA.

  Upper Delaware Named Most Endangered American River

The latest news on Marcellus Shale drilling in Wayne County:  American Rivers, a national conservation agency, has named the Upper Delaware River as the most endangered river in the nation due to proposed natural gas drilling in its watershed.  See today's Times-Tribune for the rest of story, and for the list of endangered rivers.

Citizen action surrounding decisions about whether and how to drill in Wayne County has been impressive.  This latest news might bring even more people into the mix.

  Marcellus Shale - Where Do You Fit In?

Another interesting piece about Marcellus Shale drilling appeared in today's Times-Tribune.  The paper ran a "middle path" editorial which observed that drilling will have both costs and benefits, and that while some people in our region will come out winners, others will not, as their property values will be negatively affected.

Mostly, the editorial focused on a bill in Harrisburg that would charge the industry a severance tax.  Opponents of the tax say it will stifle development, but evidence suggests otherwise - drillers in other regions generally consider such taxes part of their business costs.  Why should Pennsylvania taxpayers be left with the burden of remediating infrastructure and attending to the social costs of drilling if those who will profit most from development can be held accountable?

  Marcellus Shale's Potential Impact

Those who support developing the Marcellus Shale formation for natural resource extraction generally point to the economic benefits such development will have both for individuals within our region and for our region as a whole.  They make compelling arguments, although, as yesterday's Times-Tribune points out, disagreement remains over the actual number of jobs and income drilling will generate.

The industry claims it can bring 200,000 jobs and $18 billion into the state.  Economic experts outside the industry, however, say such claims are unrealistic and inflated.

The actual impacts remain to be seen, but Pennsylvanians should remain vigilant that their rights and interests drive the discourse, as it will be very easy for those rights and interests to be swallowed up by big industry and politics as debates over drilling continue to gain momentum.

  WCOGTF Meeting Offers Glimpse into Marcellus Shale Contentions

I have blogged several times recently about Marcellus Shale drilling projects being planned and implemented throughout our region.  Most recently, I wrote about Wayne County; just today, looking through the River Reporter, I found an article that shows just how divided local communities can be over the issue of resource extraction.  

The article detailed the discussion at the first public meeting of the Wayne County Oil and Gas Task Force (WCOGTF), the latest set of letters in an alphabet soup of competing interests.  One issue the task force raised that I hadn't heard discussed in the press before was the rights of nearby non-leaseholders.  Certainly, the drilling will impact everyone in the region.  Do those whose land is not of interest to the development companies have any say in whether drilling should or should not move ahead on adjoining land?

  Delaware River Basin Commission Developing Wayne County Drilling Regulations

The Times-Tribune reports that as drilling for natural gas in the Marcellus Shale formation becomes a reality throughout much of our region, the Delaware River Basin Commission, which regulates activities impacting the watershed and which makes up most of Wayne County, is developing its own standards for natural gas drilling.  

Though exploration may continue, no production will happen until the Commission is satisfied that its standards will be met.  The Commission could take months, or even up to a year, to reach its decision about what "safe drilling" should mean.

Careful progress is important both to the Commission and to the Northern Wayne Property Owners Alliance, homeowners who have collectively leased at least 100,000 acres to corporate developers.  With all these commissions, alliances and corporations in the mix, who can you trust to represent your own interests?

  Monroe County Marcellus Shale Forum Scheduled

My last blog concerning natural gas drilling in the Marcellus Shale formation focused on what has been happening recently in Wayne County, but Monroe County is also beginning to have conversations about the potential benefits and drawbacks of extracting gas from this huge natural formation.

A few days ago, the Pocono Record reported that the League of Women Voters of Monroe County will host a free, public forum at the Hughes Eastern Monroe Library Community Room  at 10 AM on March 6th to discuss the perspectives of speakers representing a variety of backgrounds.  

The League of Women Voters is in the midst of a one-year study to figure out the effect that drilling will have on Pennsylvania's natural resources, infrastructure, tourism and economy.  It stresses that anyone living on the formation or in the counties with pipelines could be impacted.

Natural gas drilling in Pennsylvania's Marcellus Shale formation has made news repeatedly this past year.  As I have stated before, the mass tort, environmental and real estate/contract litigation arising from Marcellus Shale gas exploration and mining is a very pressing legal issue to many in Pennsylvania.

Until now, Wayne County has remained removed from the controversies associated with drilling, but according to today's Times-Tribune that will soon change.  Exploratory wells are planned for this summer, and production is anticipated to begin in 2011 if developers receive their permits.

Some citizens oppose the drilling.  The group Damascus Citizens for Sustainability, for example, insists that,  "people have a constitutional right to clean air, pure water, and the preservation of the natural, scenic, historic and esthetic values of the environment."  Their website lists numerous instances in which drilling has led to water contamination.  

Given the potential for water pollution, it remains to be seen whether the Delaware River Basin Commission, a multi-state regulatory agency, will clear the way for production drilling to begin.
